RENT A BOAT OR JET SKI TODAY!
RENTAL AGREEMENT
LESSEE(S) IS/ARE TO READ ALL PAGES OF THIS AGREEMENT AND SIGN DOCUMENT. ANY PERSON OVER 25 THAT WILL DRIVE THE VESSEL MUST SIGN A WAIVER. LESSEE(S) AND DRIVER(S) ARE RESPONSIBLE FOR ALL PASSENGERS INCLUDING CHILDREN AND PETS. MINIMUM AGE OF DRIVER is 25 yrs.
In consideration of this agreement, Hartwell Pontoon Rentals, LLC; also operating as Lake Hartwell Pontoon Rentals (LHPR), this includes all agents, representatives, employees, successors, insurers, and subsidiaries (herein after referred to as the LESSOR) and agrees to lease to the undersigned (herein referred to as the LESSEE(S), that is applicable to all renters, operators, passengers, and occupants of the boat and all equipment described herein. In the event the boat is not returned at the specified time herein, said LESSEE(S), agrees to pay OVERTIME at the rate of $25 for every 15 minutes late when contracted for full-day rental.
THE BOAT AND THE EQUIPMENT DESIGNATED FOR THE RENTAL WILL FULFILL THE REQUIREMENTS FOR THE PURPOSES FOR WHICH IT IS LEASED. THE LESSEE(S) AGREES TO OPERATE THE BOAT IN ACCORDANCE WITH ALL SAFETY RULES AND REGULATIONS. HE/SHE FURTHER CERTIFIES THAT HE/SHE HAS READ AND UNDERSTANDS ALL RULES AND REGULATIONS REGARDING THE OPERATION AND USE OF THE BOAT AND ALL EQUIPMENT. THE LESSEE(S) HAVE WATCHED THE SAFETY VIDEOS, READ AND UNDERSTANDS THE U.S. COAST GUARD SAFETY REGULATIONS SENT TO LESSEE(S) IN THE RENTAL CONFIRMATION. THE LESSEE(S) UNDERSTANDS AND ACCEPTS ALL RULES.
THE LESSEE(S) AGREES TO REPORT ANY ACCIDENT, MALFUNCTION, OR BREAKDOWN OF RENTAL BOAT OR EQUIPMENT IMMEDIATELY. If, in the event of a breakdown, malfunction, or discovery of a defect of the rental boat or equipment, accepted by the LESSEE(S), report and/or seek assistance for said issue by calling: 864-824-8579. IN A LIFE-THREATENING EMERGENCY CALL 911 IMMEDIATELY!! Continued use of the boat or equipment shall be entirely at the LESSES(S) risk and thus LESSEE(S) assumes all liability of injury and damage to all persons and/or property that may become involved by continued use. In the event of a breakdown needing assistance, time lost is not a guaranteed refund. In the event of a dispute concerning physical damage to the vessel, pictures are on file. Upon request, pictures of the boat will be disclosed to LESSEE(S) as evidence of condition of the boat before LESSEE(S) had taken possession of the vessel.
LESSEE(S) agrees not to use or permit the use of; A) rental boat for any UNLAWFUL purpose; B) operating or using the boat or equipment in a careless manner; C) operating or using the boat or equipment while under the influence of alcohol, narcotics (prescribed or other), or any other mentally or physically altering substances; D) operation by any other person(s) not a signatory of this agreement. The signatory/operator of this vessel must be at least 25 years of age.

LESSEE(S) agrees that ALL individuals under the age of 12, AND individuals that are unable to perform the lifesaving ability to swim, MUST WEAR A LIFE JACKET OR PERSONAL FLOATATION DEVICE (PFD) THAT IS COAST GUARD CERTIFIED AT ALL TIMES!! This includes, but not limited to, dock, boat, beach area, floating device, tube, canoe, paddle board, wake board, or any time person(s) is/are in or near the water. NO EXCEPTIONS!
LESSEE(S) acknowledges his/her responsibility for the safe and proper operation of the boat and for the safety and welfare of other boaters, persons and passengers. It is AGREED AND UNDERSTOOD BY LESSEE(S) that the Lessor shall NOT be held liable for damages, inconveniences, or time lost caused by an accident, fail to function, or malfunction of the rental boat. Even if such damage arises out of negligence or fault of the LESSOR. The LESSEE(S) agrees that any damage caused to the vessel while in the LESSEE(S) care, custody, or control is the responsibility of the LESSEE(S) and will indemnify LESSOR to the full extent of repair.
LESSEE(S) further agrees to indemnify and hold harmless the LESSOR and agents, affiliates, and personnel from and against any and all claims for loss of, or damage to, property or injury to persons (including, but not limited to, dismemberment or death) resulting through the use, operation, or possession of said rental boat and/or equipment.
LESSEE(S) agrees to hold LESSOR harmless should loss or damage occur to ANY of LESSEE’S personal property while being carried on or in or around the boat, including loss, damage by fire, water, theft, or drowning and/or death. Any resultant expenses from any of the foregoing risks, even if the risks arise out of fault or negligence of the LESSOR are the responsibility of the LESSEE(S). Any monies due to LESSOR and in the event of a suit by LESSOR(S) OR LESSEE(S), to recover said lost time, damages, and rental fees due to the LESSOR(S) OR LESSEE(S), by enforcing terms, conditions, and/or provisions thereof will occur in the county of the Lessor, Anderson County, SC.
The LESSOR is not responsible for ANY damage to, or loss of, vehicle or contents of said vehicle, in any parking area where any and all vehicles are stationed while LESSEE is in a rental agreement with LESSOR.
I/We, the LESSEE(S), am/are aware of, and understand the U.S. COAST GUARD WATER SAFETY RULES POSTED ON THE WEBSITE AND AGREES TO ADHERE TO SAID RULES.
I/We, the LESSEE(S) will NOT remove supplied equipment during the time of the rental and will operate the boat within the limits of the lake. I/We have familiarized myself/ourselves with the map of the areas.
TOWING OR TRANSPORTING ANYTHING ON/IN, AROUND, BEHIND, BESIDES, OR OTHERWISE ON/IN THE RENTAL BOAT IS AT LESSEE(S) RESPONSIBILITY. ALL LIABILITY IS ASSUMED BY LESSEE(S). I/We, the LESSEE(S) RELEASE ALL LIABILITY OF HARTWELL PONTOON RENTALS, LLC AND PERSONNEL, OR AFFILIATES OF ANY PERSONAL INJURY OR PROPERTY DAMAGE. THIS APPLIES EVEN IF DAMAGE IS FOUND TO BE THE LESSORS FAULT.

This certifies that I/We, the LESSEE(S) am/are experienced and capable in all aspects of the handling and operations of a boat such as the one being rented. LESSEE(S) agrees that the boat will not be occupied by a greater number of persons and weight limit than is shown on the website, not the sticker posted by the manufacturer on the boat.
I authorize the LESSOR to charge the card that was provided for any damages to the boat or equipment, this will include lost or stolen equipment, at the replacement cost which includes installation when applicable. A fee list can be provided at the LESSEE(S) request.
LESSEE(S) accepts any and all fines incurred by wrongful operation as deemed by Anderson County Law Enforcement, DNR, U.S. Coast Guard officials or any other governing agency and its jurisdiction on Lake Hartwell. ANY FINE IS THE SOLE RESPONSIBILITY OF THE LESSEE(S).
ACKNOWLEDGMENT OF RISKS: The LESSEE(S) accepts the risks and acknowledges that these are in no way the responsibility of Hartwell Pontoon Rentals, LLC. Some of the risks being in/on a vessel or participating in water sport activities on Lake Hartwell include, but are not limited to:
1. Changing water flow, currents, wave actions and wakes of other motorized vessels of any kind.
2. Collisions of any kind including, but not limited to, the following: other participants, the boat, other boats, man-made or natural objects.
3. Collision, capsizing, sinking, or other hazards which results in wetness, injury, exposure to the elements, hypothermia, sun burns, heat stroke, heat exhaustion, exposure, dehydration, drowning, and/or death.
4. Attack by or encounter with other individuals, insects, wildlife, or marine life forms.
5. Equipment failure or operator error.
6. Loss of balance, physical condition, ability to operate equipment, swim, or ability to follow directions.
7. Wind, inclement weather, lightening, variances and extremes of wind, weather, and temp.
8. Any failure on the part of the Dam.
9. Any unanticipated risks that may result in injury, illness, or death.
Boat rental does not include the use of fuel, tax, or convenience fee for refueling. The boat provided arrives with a full tank of gas and LESSEE(S) will be charged for fuel used, tax, and convenience fee for service of refueling. Fuel used is non-ethanol.
WAIVER/RELEASE OF LIABILITY: By the execution of this release, the undersigned voluntarily releases, forever discharges, and agrees to indemnify and hold harmless LESSOR from any and all liability of any nature for any reason arising from injuries to persons both in LESSEE(S) control and/or other persons, in the event of an accident sustained as a result of any and all activities related to the rental operation or use of equipment provided by LESSOR REGARDLESS OF THE CAUSE. The undersigned takes full responsibility for such injuries and damages which may occur to a third-party, this includes property. LESSEE(S) further agrees that LESSOR shall NOT be liable for any loss or theft of personal property. The undersigned specifically agrees the LESSOR shall NOT be responsible for such injuries, damages, loss, or theft even in the event of negligence or fault of the LESSOR, whether such negligence is present at the signing of this release or takes place in the future.

EXPRESS ASSUMPTION OF RISK: The undersigned hereby agrees that he/she is renting, operating, and doing so voluntarily, or using the equipment provided by LESSOR AT THEIR OWN RISK.
The LESSEE(S) has read and understands all rules and regulations, not only stated by personnel, but has read all the above contract. The LESSEE(S) assumes ALL responsibility that his/her family and or guests will obey the rules.
THE TERMS AND CONDITIONS ON ALL PAGES OF THIS CONTRACT CONTAIN THE ENTIRE UNDERSTANDING BETWEEN LESSEE(S) AND LESSOR AND NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT.
I/WE HAVE READ ALL PAGES OF THE RENTAL AGREEMENT AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AS SET FORTH ON ALL PAGES THAT I/WE HAVE INITIALED OR SIGNED.
